Affiliate Program Terms of Service

These Affiliate Program Terms of Service (“Agreement”) govern participation in the Impact Digital Marketing Affiliate Program (the “Program”). By applying to or participating in the Program, you (“Affiliate”) agree to these terms.

1. Eligibility & Approval

All affiliate applications are subject to approval. We reserve the right to approve or reject any application at our sole discretion.

2. Referral Tracking

Affiliates are provided with unique tracking links used to identify referrals. Only paid subscriptions that are properly tracked through these links are eligible for commission. We are not responsible for lost referrals due to technical issues, tracking prevention, or misuse of affiliate links.

3. Commission Structure (Subscriptions Only)

  • Commissions are earned only on paid subscriptions.

  • No commissions are paid for installs, trials, or free usage.

  • Commission rates, eligible plans, and payout rules are defined within the affiliate dashboard and may change at any time.

  • Commissions may be calculated based on gross or net subscription revenue, as defined in the program settings.

  • Refunds, chargebacks, failed payments, credits, and promotional discounts may reduce or void commissions.

4. Subscription Cancellation & Uninstalls

  • Commissions stop when a referred customer cancels or uninstalls the app.

  • We reserve the right to reverse commissions for refunded or disputed subscription charges.

  • Uninstalls may immediately terminate commission eligibility unless otherwise stated in the program settings.

5. Affiliate Conduct

Affiliates may not:

  • Make false, misleading, or exaggerated claims about Swatchify.

  • Impersonate Swatchify or misrepresent affiliation.

  • Engage in spam, deceptive advertising, or unethical promotion practices.

  • Violate any laws, advertising standards, or platform policies.

Violation of these rules may result in immediate termination and forfeiture of unpaid commissions.

6. Taxes & Payment Information

Affiliates are responsible for providing accurate payment, tax, and business information where required (including VAT or tax ID). Affiliates are solely responsible for reporting and paying all applicable taxes on earned commissions.

7. Termination

Either party may terminate participation at any time. Upon termination:

  • Fraudulent or non-compliant commissions will be voided.

  • Access to affiliate links and dashboards may be revoked.

  • Legitimately earned commissions may be paid at our discretion, subject to payout thresholds.

8. Program Changes

We reserve the right to modify or discontinue the Program or these terms at any time. Continued participation constitutes acceptance of any changes.

9. Limitation of Liability

Swatchify is not liable for indirect or consequential damages arising from affiliate participation. Total liability will not exceed commissions paid in the previous twelve (12) months.

10. Governing Law

This Agreement is governed by the laws of the United States and the state in which Swatchify operates.
